Malpractice is an error that occurs due to a physician’s unfamiliarity with the technical aspects that every physician is supposed to be familiar with. According to Article 14 of Medical Liability Law No. 10 of 2008, “Malpractice is an error that occurs due to the practitioner’s lack of familiarity with the technical aspects of which each practitioner is supposed to be familiar, due to negligence or insufficient efforts.” Physicians are responsible for negligently ignoring medical standards, failing to follow technical issues, and not receiving proper care as would be expected from a skilled medical practitioner.
The new law imposes severe penalties on medical practitioners who commit serious medical errors. Sigh of relief for doctors, as a practitioner may not be arrested or imprisoned until the medical committee issues its final decision in accordance with the new law.
